Salman May Get 10 Years In Jail For Hit And Run Case

Bollywood star Salman Khan will be tried under culpable homicide case in the hit and run case of 2002, if proved guilty he may get ten years in jail. This incident happened 10-year-ago when Salman’s Toyota Land Cruiser crashed into a bakery in Mumbai injuring four and killing one person sleeping on the pavement. It is a setback for Salman Khan that the court has ruled that he will be tried for culpable homicide not amounting to murder in a 2002 hit-and-run case. The court also asked Salman Khan to appear before the sessions court on March 11, 2013.

While Salman Khan thinks the incident was merely an accident and he did not have any intention to kill anyone. The Bombay high court had held that Section 304 part II of the Indian Penal Code (culpable homicide not amounting to murder) was not applicable in the case. It decided that Salman Khan should be tried under Section 304 A of the Indian Penal Code (rash and negligent driving) and other related sections. So accordingly the court had framed charges against him under section 304 A of the Indian Penal Code (rash and negligent driving), 279 (rash driving), 337 (causing minor injuries), 338 (causing major injuries) and 427 (negligence).

But Mumbai police had again sought that Salman Khan be tried under more serious charge of ‘culpable homicide not amounting to murder’. The court said that there is evidence against Salman Khan to evoke culpable homicide and directed him to appear before sessions court on March 11, 2013.

Another complaint was filed by social activist Santosh Daundkar regarding delay in trial of this hit and run case. The trial is dragging on for the past 10 years. Santosh Daundkar, in his complaint, alleged that the prosecution had joined hands with Salman Khan. He is also of the view that the police also helped Khan to drag the case and produced false evidence to manipulate facts. Daundkar’s lawyer Abha Singh said, “While other high profile cases were over within a few years, the case against Khan has been dragging for 10 years. The medical officers produced before the court were not the ones to whom summons were issued. There has been a manipulation of evidence.”

Now Salman Khan and his fans must be waiting for March 11, 2013 to see what verdict the court will deliver regarding the case.
